Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the first respondent to cancel open auction that was held on 15.06.2022 conducted by the second respondent Medical College for the supply of food products like vegetables, fruits (perishable products) etc. to be supplied to the second respondent Medical College for the period from 01.07.2022 to 31.12.2022 (half yearly) and consequently direct the second respondent to issue fresh notification calling for tender applications for the supply of perishable food products by giving opportunity to the petitioner herein.

ORDER

This Writ Petition has been filed for a direction directing the first respondent to cancel the open auction that was held on 15.06.2022, which was conducted by the second respondent Medical College for supply of food products like vegetables, fruits (perishable products) etc., to be supplied to the second respondent Medical College for the period from 01.07.2022 to 31.12.2022.

2. The learned Government Advocate appearing for the respondents submitted that the open auction scheduled to be held on 15.06.2022 was already cancelled and now no contract has been awarded to any third party and that the entire food products are being supplied to the Government Hospitals by Society.

3. In view of the above, nothing survives for further adjudication in this writ petition. Therefore, the writ petition is dismissed as having become infructuous. Consequently, connected miscellaneous petition is closed. No costs.
