Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing 1st and 2nd respondents to implement/expedite vide letter dated 13.12.2023 in Na.Ka.No.A7/1164/2023 and reference No.6466024 issued by the 2nd respondent and take appropriate action to identify space for cremation/burial ground and construct the cremation facility at T.K. Pudhu Mandabam, Mel Thotti and Kheez Thotti at T.Keeranur Panchayat.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) In compliance of the order passed by this Court earlier, petitioner has now filed an affidavit disclosing various difficulties faced by the residents of three villages, namely T.K.Pudhu Mandapam, Mel Thotti and Kheez Thotti.

2. It is stated that persons belonging to other communities are raising an objection with regard to the use of burial ground and representation in that regard has been made.

3. Having alloted burial ground for the use of residents of the aforesaid three villages, it is the bounden duty of administration to

ensure that the residents of three villages are allowed to use the burial ground identified by the administration without any objection or resistance that may be offered by any one.

4. It would be proper that the Block Development Officer, Tirukoilur Taluk calls for a meeting of the Panchayat President of three villages, including the representatives of other communities who are said to be obstructors, to discuss and ensure that no obstruction is allowed for peaceful use of the identified burial ground to the people of three villages. If it is found that villagers of three villages are being obstructed to use the burial ground, stern action, including police action, shall be taken.
