Respondent Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondent bank to accept the balance payment with interest as per the one time settlement letter dated 10.08.2023 after adjusting a sum of Rs.1,09,84,000/-

(Rupees one crore and nine lakhs and eighty four thousand only) as against the sanctioned amount of Rs.1,22,20,000/- (Rupees one crore and twenty two lakhs and twenty thousand only) within the time frame fixed by this Honourable Court.

(Order of the Court was made by the Hon'ble Chief Justice) Learned counsel for petitioner appeared in the first round and on his request, the matter was passed over. In the second round, learned counsel for petitioner is absent.

2. In this petition under Article 226 of the Constitution of India, petitioner seeks a direction to the bank to accept the balance payment with interest as per the One Time Settlement letter dated 10.08.2023.

3. Learned counsel for respondent bank, on instructions, submits that in the original One Time Settlement, three months'

time was granted to pay the amount by 29.09.2023. However, petitioner did not make the payment of full One Time Settlement amount on or before the due date. At the request of petitioner, the time was extended till 31.01.2024 for making payment. Again, petitioner failed to comply with the terms of payment. Therefore, One Time Settlement lapsed and failure letter was sent on 02.04.2024. As of now, there is no active application for One Time Settlement pending.

4. In view of the aforesaid, we are not inclined to grant any relief to petitioner. Accordingly, the writ petition, being bereft of merits and substance, is hereby dismissed. There shall be no order as to costs. Consequently, the interim applications are also dismissed.
