O R D E R

This petition has been filed under Section 482 of Criminal Procedure Code seeking direction upon the respondent to register the case on the complaint dated 14.08.2014 according to law.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

3. It is seen from the complaint that the petitioner entered into a agreement of sale with one Manoharan agreeing to sell 55,000 square feet of the property at the rate of Rs.180/- per sq.ft and in that total extent of 55,000 square feet, the petitioner is having some share and in respect of the petitioner's share only, the said Manoharan agreed to pay Rs.180/- per square feet. However, in respect of other co-owners the said Manoharan agreed to sell at the rate of Rs.300/- per square feet and at the time of registration of the document, the said Manoharan mentioned only Rs.100/- per square feet. The petitioner is also entitled to claim Rs.300/- per square feet, which was paid to the co-owners and therefore, the complaint was given.

4.According to me, the complaint discloses only civil transaction and no criminal offence is made out and hence this Criminal Original Petition is dismissed.
