This application coming on this day before this court for hearing, the court made the following order: Sole plaintiff in the main suit is the lone applicant herein and the sole defendant in the main suit is the lone respondent herein.

When the suit was set down for recording evidence (oral and documentary) before learned Additional Master-II, plaintiff's side witness did not turn up more than once, resulting in plaintiff's side evidence being closed.

Therefore, plaintiff has now come up with the instant application with a prayer to recall P.W.1. To be noted, learned counsel for plaintiff submits that the deponent of the affidavit filed in support of this application, i.e., Mr.P.Gopalakrishnan will depose as P.W.1 and that he will be present before learned Additional Master-II on 08.11.2018.

Learned counsel for defendant very fairly submits that he has no serious opposition or objection to this application being ordered considering the innocuous nature of the prayer.

This application is ordered as prayed for subject to the condition that P.W.1 will appear and depose before learned Additional Master-II on 08.11.2018. Sd/M.S.J.
