The complainant in a cheque bouncing case seeks leave as against the order of acquittal.

2. It has been contended by the learned counsel for the petitioner/appellant that inspite of production of documentary evidence to show that the accused has maintained a bank account with reference to which he has issued a cheque. The trial Court overlooked this aspect and rendered an incorrect finding resulting in acquittal of the respondent.

3. I have considered the submissions of the learned counsel for the petitioner/appellant and also perused the impugned Judgment.

4. This appeal present certain eminently arguable points.

5. Thus, leave is granted.

Registry is directed to process the appeal memorandum as per rules.
