ORDER

This Court had allowed the Application to condone the delay of 146 days in filing the Application under Section 5 of CPC, on 01.04.2025. This Court directed as a condition for condonation of delay that a costs of Rs.2,000/-, to be paid by the appellant to the respondents.

2. This Application has been presented on account of the fact that the petitioner was not in a position to find out the address and contact details of the learned counsel for the respondents. Consequently, he could not comply the direction.

3. Heard Mr.V.Ramanareddy, learned counsel for the petitioner and Mr.N.Kumar Raja, learned counsel for the respondents.

4. This Application filed under Section 148 of the CPC. Mr.Ramanareddy, learned counsel for the petitioner has readily come forward to pay a sum of Rs.2,000/- and the same has been accepted by Mr.K.Senthil, learned counsel representing the respondents. The reasons given in Paragraph No.5 are convincing. Unless and until, the Counsel is aware of the address of his counter part, he would not be in a position to make the payment. As the Second Appeal deals with substantial rights of parties, relating to an immovable properties and since this Court has already exercised its discretion to condone the delay on an earlier occasion, I am inclined to order the Application. Accordingly, this Civil Miscellaneous Petition is ordered.
