[Order of the Court was made by S.S.SUNDAR, J.,] (1)Mr.M.R.Gokul Krishnan, learned Additional Government Pleader accepts notice on behalf of the 1st respondent.
(2)The present writ petition has been filed seeking for issuance of a writ of mandamus directing the 1st respondent to appoint a Fit Person and to conduct enquiry from the Consultative Committee for Banking Development, Tiruppur District by considering the petitioner's
representation dated 02.05.2024.
(3)The petitioner, on the basis of his representation, has filed the present writ petition. A mandamus can be issued only to enforce a statutory obligation against an authority. In this case, the petitioner has neither indicated any statutory obligation nor the right based on any statute or principle. The writ petition, therefore cannot be entertained. Hence, the writ petition stands dismissed.
(4)However, this Court has not gone into the merits of the contentions of the petitioner in this writ petition as she has made serious allegations against the officials of the Bank. It is open to the petitioner to approach any other Forum which can go into the complaint as against the respondent / Bank and can also initiate criminal prosecution as against the Bank if she is able to prove the allegations made against the respondent / Bank or any officials of the respondent / Bank.
