Writ petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the 1st respondent to disconnect the Electricity Connection No.102050-315, in the name of M/s.Subarma Electronics owned by 2nd respondent at No.4 Meeran Sahib Street, Mount Road, Chennai-600 002.

O R D E R

The petitioner seeks for a mandamus directing the first respondent to disconnect the electricity connection given in the name of M/s.Subarma Electronics, owned by the second respondent.

2. Heard both sides.

3. Mr.P.R.Dilip Kumar, learned standing counsel takes notice for the first respondent.

4. It is seen that the petitioner and the second respondent are the land lord and the tenant respectively. It is further seen that the petitioner wants to evict the second respondent. She approached the first respondent and made a complaint for https://hcservices.ecourts.gov.in/hcservices/

disconnecting the power supply given to the second respondent. By a proceedings dated 17.08.2017, the petitioner was informed that the electricity connection standing in the name of M/s.Subrama Electronics, owned by the second respondent is in existence for more than 15 years and that the current consumption charges are being regularly paid by the second respondent without any dues. Therefore, it was informed to the petitioner that the electricity connection cannot be stopped to the second respondent, based on a dispute between the owner and the tenant. When such an order is passed on 17.08.2017 and the same has not been questioned by the petitioner, I do not think that the present writ petition filed with the relief as stated supra, can be maintained. Therefore, this writ petition is dismissed, however by granting liberty to the petitioner to agitate the matter before appropriate forum, against the second respondent. No costs.
