The petitioners, who apprehends arrest for the alleged offence punishable under Sections 174 of IPC altered into Section 306 of IPC in Crime No.103 of 2024, seeks anticipatory bail.

2. The case of the prosecution is that the marriage between the complaint's daughter and the 1st petitioner was solemnized in some 20 years ago. The allegation in the complaint is that the 1st petitioner developed illegal relationship with the 2nd petitioner and due to which their matrimonial relationship was ruined. While so on 18.03.2024, 1st petitioner's wife committed suicide by hanging herself in the matrimonial house.

3. The learned counsel appearing for the petitioners submit that 1st petitioner did not have any illegal affair with the 2nd petitioner and any other women. The allegation is totally immaterial. He would submit that petitioners are an innocent person and they have not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioners.

The learned Government Advocate (Crl.Side) appearing for the respondent submit that the 1st petitioner developed illegal relationship with the 2nd petitioner and due to which their matrimonial relationship was ruined. While so on 18.03.2024, 1st petitioner's wife committed suicide by hanging herself in the matrimonial house. Hence, he opposed for grant of anticipatory bail to the petitioner.

Considering the above facts and circumstances of the case, considering the submissions made by learned Government Advocate(Crl.side) that investigation is not yet completed and also considering the fact that 1st petitioner developed illegal relationship with the 2nd petitioner and due to which petitioner's wife committed suicide, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 05.06.2024 nsl
