ORDER
This Writ Petition has been filed to direct the 2nd respondent to de-freeze the current bank account of the petitioner herein in Bank Account No.921020040183026 (IFSC Code.UTIB0004598) maintained with the 3rd respondent based on the petitioners representation dated 04.04.2025 forthwith.
2. The learned Government Advocate (Crl. Side) based on the instructions submitted that though the petitioner is not an accused in Crime No.10 of 2025 registered for the offences under Sections 318(4) and 112 of BNS read with Section 5 and 7(3) of Lottery Regulation Act, 1998, a sum of Rs.1 lakh was transferred from the account of the 6th accused to the petitioner's account, since the petitioner is a friend of 6th accused. He further submitted that, more than Rs.5 crores were involved in this case and apart from the petitioner's account, so many accounts have been frozen. He also submitted that the investigation in this case will be completed within a period of 12 weeks.
3. Even according to the case of the prosecution, a sum of Rs. 1 lakh was transferred to the petitioner's account from the 6th accused. Hence, this Court directs the 3rd respondent to de-freeze the petitioner's account and permit the petitioner to operate his account on condition to withhold a sum of Rs.1 Lakh in the said account.
4. With the above observations and directions, this Writ Petition is disposed of . No costs.
