Respondents Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C., to direct the respondents to register the FIR as against the complaint dated 28.12.2013 in CSR No.405 of 2013 on the file of the first respondent as against the alleged persons namely Sakkarapani, Bhuwaneshwari, Bhaskaran, Dhanam and investigate the aforesaid case in a proper manner.

ORDER

This petition has been filed to direct the respondents to register the FIR as against the complaint dated 28.12.2013 in CSR No.405 of 2013 on the file of the first respondent and investigate the aforesaid case in a proper manner.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. It is represented by the learned Additional Public Prosecutor that initially petition enquiry in CSR 405 of 2013 was conducted on the complaint dated 28.01.2013. Thereafter, a regular case in Cr.No.13 of 2015 for offences under Sections 294 and 506(ii) IPC was registered by the respondent police on 29.01.2015. After investigation, the same has also been closed as 'mistake of fact' and the petitioner has been served RCS notice.

Under such circumstances, it is open to the petitioner to file protest application before the concerned Magistrate. With the above observation, this petition is closed.
