WP.No.18329 of 2009: which was filed praying to issue a writ of certiorari to call for the records on the file of the 1st respondent in proceedings Na.Ka.1573/2009/B and dt.14.8.2009 and the consequential proceedings of the 2nd respondent in Na.Ka.No.574/2009 and dt.1.9.2009 and quash the same as illegal incompetent and without jurisdiction.

J U D G M E N T

(Delivered by G.Jayachandran,J) This appeal is directed against the order dated 30.9.2010 made in W.P.No.18329 of 2009.

2. Challenging the order of his transfer, the appellant filed writ petition and the same was dismissed by the learned https://hcservices.ecourts.gov.in/hcservices/

single Judge holding that the order of transfer cannot be interfered with by the Courts unless it is in contravention of any statutory rule or mala fide. Hence, this writ appeal.

3. The learned Special Government Pleader submitted that the appellant has been retained in the same place and therefore, nothing survives in this appeal.

4. Recording the above submission, this writ appeal is dismissed as infructuous. However, there shall be no order as to costs. Consequently, M.P.No.1 of 2010 is also dismissed.
