Prayer:

Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 4th respondent to survey the petitioner's land of an extent of 4488 sqft. of vacant site sketch comprised in Old Survey No. 51 and New Survey No. 487/1 & 487/3, Palnellore Village, Sriperubudur Taluk, Kanchipuram District and mark the boundary lines on all sides after giving notice to the respondents 5 to 7 and other interested persons based on the application dated 19.05.2022 within the time frame fixed by this Court.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the 4th respondent to dispose of the application of the petitioner dated 19.05.2022.

2.The case of the petitioner is that the petitioner's father inherited the 2/4

property comprised in Survey No.51 and New Survey No.487/1 & 487/3, Palnellore Village, Sirperumbudur Taluk, Kanchipuram District, executed between the petitioner's father and the respondents 5 to 7 herein. Subsequently, the petitioner's father had executed a registered settlement deed, dated 22.07.2010 by way of Doc.No. 6974 of 2010 on the file of Sub Registrar Office, Sriperumbudur, in favour of the petitioner. Thereafter, the petitioner has been in possession and enjoyment of the same. In this regard, the petitioner submitted an application before the 4th respondent/The Taluk Head Surveyor to survey the petitioner's land and mark the boundary lines. However, no action has been taken by the 4th respondent so far. Therefore, the petitioner has come forward with the present writ petition. 3.The learned counsel appearing for the petitioner submitted that this Court may issue direction to the fourth respondent to consider the petitioner's representation dated 19.05.2022 and to pass appropriate orders within a reasonable time frame.

4.Considering the limited request made by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the fourth respondent to consider the petitioner's application dated 19.05.2022, on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner and pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order.
