..Respondents Prayer:- Writ petitions filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the Refusal Check Slip in refusal number RFL/Madukkarai/4/2020 dated 23.07.2020 and to quash the same as illegal and incompetent and consequently direct the respondent to register the decree dated 01.02.2019 passed in O.S.No.368 of 2018 on the file of the III Additional Subordinate Judge, Coimbatore.

ORDER

This writ petition has been filed challenging the refusal check slip issued by the respondent, wherein the decree that was presented for registration was refused to be registered on the ground that both the parties were not present at the time of presentation of the documents.

The learned counsel for the petitioner submitted that the decree will be presented before the respondent by the concerned parties and the respondent can be directed to register the decree.

Heard Mr.T.M.Pappiah, learned Special Government Pleader appearing on behalf of the respondent. 4.

Taking into consideration the facts and circumstances of the case and also of the fact that the petitioner has undertaken to be present at the time of presentation of the https://hcservices.ecourts.gov.in/hcservices/

documents, there shall be a direction to the respondent to receive the decree passed in O.S.No.368 of 2018 dated 01.02.2019 and register the same, if it is otherwise in order and subject to the petitioner paying the necessary stamp duty and registration fees.

This writ petition is disposed of with the above directions. No costs.
