The present Writ Petition has been filed for issuance of Writ of Mandamus, to direct the 3rd respondent to return the Original Certificates given by the petitioners at the time of admission for the first year B.Tech IT/MBA Course https://hcservices.ecourts.gov.in/hcservices/

for the academic year 2007-2008 and for refund of the Course and Hostel fees paid by them.

2. The petitioners joined in the PSN College of Engineering & Technology for the B.Tech degree programme/ MBA degree course for the academic year 2007-2008. They joined the College in August, 2007. It is the allegation of the petitioners that they were asked to join another College viz., the PSN College of Engineering. Since the petitioners were not prepared to join the PSN College of Engineering, they left the studies and went back. It is their allegation that they demanded return of fees, but, it was returned.

3. The Writ Petition was admitted on 19.10.2009. When the matter has come up for final hearing, though technical plea like maintainability of the Writ Petition for the relief claimed, has been raised by the respondents, the parties after negotiation, have agreed that the third respondent/Institution will give refund of 50% of the fees as demanded by the petitioners. The amount shall be paid within a period of six weeks from today (03.08.2018). The Demand Draft will be handed over to the learned counsel appearing for the petitioners.

4. With the above terms, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
