ORDER

Seeking a direction to the 2nd respondent to Register a case on the basis of the complaint given by the petitioner dated 05.11.2013, the petitioner has come up with this petition.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3. It is seen that the complaint given by the petitioner dated 05.11.2013 to the Commissioner of Police was sent to the Deputy Commissioner of Police Mylapore and thereafter, no action appears to have been taken thereon. On a reading of the complaint it appears that one Dilshath Begam had cheated the petitioner and in order to cover the cheating, she has earlier lodged a complaint against this petitioner, which was enquired into by the Inspector of Police, E1-, Mylapore Police Station and the complaint was closed on 13.11.2013. The allegation of the petitioner is that the said Dilshath Begam had cheated her jewelery and money.

Under such circumstances, this Court directs the petitioner to lodge a fresh complaint in person before the Deputy Commissioner of Police, CCB and he shall forward the same to the Inspector of Police for enquiry and for taking action in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)].

5. This Criminal Original Petition is disposed of with the above direction.
