ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.01.2025 for the alleged offences under Sections 395 and 397 of Indian Penal Code in Crime No.308 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other persons committed dacoity by threatening the de facto complainant and his wife and robbed approximately 8 sovereigns of gold jewel, 11⁄2 kilograms of silver articles and cash to a sum of Rs.84,000/-. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case without any basis. It is further submitted that the petitioner is ready to cooperate with the investigation and will appear before the respondent police as and when required. The learned counsel further contended that the petitioner is ready to abide by any conditions imposed by this Court. Hence, he prayed for the grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing the grant of bail to the petitioner, reiterated the prosecution case and submitted that the petitioner was arrested on 29.01.2025. He further submitted that thirteen previous cases are pending against the petitioner.

5. Heard both sides and perused the materials available on record.

6. From the submissions made by the learned counsel on either side, it is seen that the petitioner has got thirteen previous cases. This Court is of the firm

view that if the petitioner is enlarged on bail at this juncture it will cause negative impact in the society. Hence, this Court is not inclined to enlarge the petitioner on bail. Accordingly, this Criminal Original Petition is dismissed. 07-05-2026 SHL/NSL To:
