Respondents Prayer : - Writ Petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents 1 to 3 herein to consider the petitioner's representation dated 16.04.2021 sent for rectifying the erroneous classification of his lands measuring 0.22.5 hectares in SF.No.40/1 [Old SF.No.40/2] situate at Sithanapalli Village, Hosur Taluk, Krishnagiri District as ''Aanadheenam lands'' in accordance with law and within a stipulated period. ORDER

(1) Mr.Yogesh Kannadasan, learned Government Advocate accepts notice on behalf of the respondents.

(2) The writ petition has been filed in the nature of a mandamus seeking a direction against respondents1 to 3 to consider the representation dated 16.04.2021, to rectify the classification of the lands measuring 0.2.5 Hectares in SF.No.40/1 Old SF.No.40/2 in Sithanapalli Village, Hosur Taluk, Krishnagiri District.

(3) It has been claimed by the petitioner that the lands have been classified as Aanadheenam lands and the petitioner questions such classification. It is claimed by the petitioner that his grandfather had purchased the said lands in the year 1944 by way of a registered Document registered as Doc.No.912/1944 in the office of the Sub Registrar, Hosur. It is further claimed that the family has been in possession as owners of the said lands. The petitioner claims that the lands are patta lands, but had been classified as Anaadeenam lands during the UDR survey. In this connection, the petitioner had sent a representation on 16.04.2021.

(4) A mandamus is issued to the 4th respondent/District Revenue Officer, Krishnagiri to examine the said representation. It would be advisable if the petitioner gives a fresh copy of the said representation to the 4th respondent within a period of three weeks from the date of receipt of a copy of this order and thereafter, an obligation is placed on the 4th respondent, to issue notice to the petitioner and any other individual concerned, examine revenue records and thereafter, take a considered decision with respect to the representation. At any rate, the said exercise should be completed within a period of nine weeks from the date of receipt of a copy of the fresh representation from the petitioner.
