3.On going through the averments and submission made by the learned counsel for the Appellant, I find no prima facie case in favour of the Appellant and therefore, no prejudice would be caused to the claimant in numbering this petition without notice.

Accordingly, this Petition is ordered and the delay of 38 days, is condoned.
