ORDER

This writ petition has been filed to direct the 1st respondent to take appropriate action on the representation of the petitioner herein dated 06.08.2021 and 04.01.2025 for creating bogus fabricated document styled as a Rental Agreement in the name of the Sri Venugopalswamy Devasthanam. 2.The petitioner claiming to be the original owner of the property, situate at Town Railway Station Road, Salem, claiming under his grandfather one, C.M.Narayana Chettiar, states that by virtue of testamentary succession, the property is now vested with the writ petitioner. The respondents 3 to 5, according to the writ petitioner have created a forged lease agreement, in collusion with the 3rd respondent, representing Sri Venugopalaswamy Devasthanam, behind the back of the writ petitioner. The petitioner has complained to the authorities under the HR & CE Act to 2/6

take action against the 3rd respondent, who is acting as the Managing Trustee. The representations dated 06.08.2021 and 04.01.2025 are kept pending, without any action being taken thereon. The writ petitioner therefore seeks issuance of a writ of Mandamus to issue appropriate directions to the 1st respondent/Joint Commissioner to dispose of the petitioner's representation regarding the fabricated lease agreements executed by the 3rd respondent in favour of the respondents 4 and 5. 3.Mr.K.Karthikeyan, learned Government Advocate takes notice on behalf of the respondents 1 and 2. In view of the limited relief sought for in the writ petition, I am inclined to dispense with notice to respondents 4 and 5.

4.The 1st respondent shall conduct necessary enquiry and dispose of the petitioner's representation dated 04.01.2025, on merits and in accordance with law, after giving a fair opportunity to the both the parties concerned, within a period of 12 weeks from the date of receipt of a copy of this order.
