Petition filed under Article 226 of the Constitution of India for the issuance of a writ of mandamus, directing the respondents to permit the petitioner to perform Annadhanam on the 11th year death ceremony and permit the petitioner to display the banner on that day as stated in the representation dated 16.09.2015. ORDER
The petitioner made a representation dated 16.09.2015 seeking permission to perform Annadhanam on the 11th year Death Ceremony of her husband. As the said request is pending consideration, the present writ petition has been filed.
2. The learned counsel for the petitioner submitted that the petitioner seeks permission only to perform Annadhanam on the 11th year Death Ceremony of her husband.

3. Based upon the counter affidavit, the learned Government Advocate submitted that while there is no problem in considering the request for performing Annadhanam, the other activities can never be permitted, considering the sensitiveness of the areas and the law and order problem, that is likely to be created.
4. Considering the submissions made on both sides, the writ petition stands disposed of making it clear that the petitioner shall be permitted by the respondents to perform Annadhanam alone on the 11th year Death Ceremony of her husband. In other words, if the petitioner indulges in other activities other than Annadhanam, it is open to the respondents to take appropriate action in accordance with law including the cancellation of the said permission.
5. It is further made clear that the petitioner can have banners indicating the proposed Annadhanam in the place which has been earmarked for that purpose and no banners can be erected for any other purpose. No costs.
