The Station House Officer Nemili Police Station Vellore District (Crime Nos.248, 249 & 250 of 2020) COMMON PRAYER: Criminal Original Petitions are filed under Section 439 of Criminal Procedure Code to enlarge the petitioner on bail in Crime Nos.248, 249 & 250 of 2020 on the file of the respondent police.

Side) COMMON ORDER (These cases have been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 31.08.2020 for the offences punishable under Section 379 of IPC @ 392 of IPC @ 395 of IPC, in Crime Nos.248, 249 & 250 of 2020, on the file of the respondent police, seeks bail. 2..The case of the prosecution is that the petitioner along with other accused have committed the theft of motor cycle and cellphone of the defacto complainant. Hence the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner has been implicated in this case based on the confession statement given by the other accused. occurrence. He would further submit that the petitioner has been suffering incarceration from 31.08.2020 and prays for grant of bail. 4.The learned Government Advocate (Criminal Side) would vehemently oppose stating that the petitioner is a habitual offender. She would further submit that apart from the above three cases, he has also involved in another case registered by the Balu Chetty Chattram Police Station in Crime No.1151 of 2020 for the offences committed under Section 294(b), 353 r/w 25 of Arms Act. She would further submit that the petitioner was arrested very recently on 31.08.2020 and the investigation is in preliminary stage.

5.Taking into consideration of the fact that the petitioner is a habitual offender and involved in four cases of similar nature and other cases are yet to be ascertained and he was arrested very recently on 31.08.2020 and the investigation is in preliminary stage, this Court is not inclined to grant bail to the petitioner. 6.These Criminal Original Petitions stand dismissed accordingly.
