Respondents PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the 1st respondent herein to provide police protection for surveying and measuring the lands of the petitioner measuring 0.81 cents in S.F.No.28/4 B1A, situate at Motham Agraharam Village, Hosur Taluk, Krishnagiri District and for fencing the said lands thereafter by the petitioner at his costs.

O R D E R

This Criminal Original Petition has been filed to direct the 1st respondent herein to provide police protection for surveying and measuring the lands of the petitioner, measuring 0.81 cents in S.F.No.28/4 B1A, situated at Motham Agraharam Village, Hosur Taluk, Krishnagiri District and for fencing the said lands thereafter by the petitioner at his costs. https://hcservices.ecourts.gov.in/hcservices/

2. The contention of the petitioner is that the petitioner had paid necessary fees for surveying his property. The revenue authorities, on a perusal of the petitioner's documents as well as the revenue records, getting satisfied, had directed the petitioner to remit the survey fees. The petitioner also remitted the survey fees, thereafter, for some reason or the other, the surveyor has not yet surveyed the land and hence, the above petition.

3.The learned Additional Public Prosecutor submits that on the earlier direction of this Court, the petitioner was served with notice to appear on 15.10.2021, to verify the genuineness of the petitioner's claim and also to coordinate with the revenue officials so that necessary directions to the revenue officials to conduct survey is given.

4.In view of the same, the petitioner is directed to appear before the respondent police along with the order copy and necessary supporting documents, thereafter to co-ordinate with the surveyor and date to be fixed for the survey to be conducted and the respondent police to provide police protection to the officials. Accordingly, this Criminal Original Petition is disposed of.
