2. Notice to respondents 1 and 2 is dispensed with since they remained ex parte before the Tribunal.

3. Mrs.R.Rathna Thara, learned counsel, takes notice for third respondent.

4. Heard the learned counsel on either side and perused the records.

5. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, this miscellaneous petition is allowed and the delay of 23 days in filing the above appeal is condoned.

Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course. Registry is directed to print the name of Mrs.R.Rathna Thara, learned counsel for third respondent at the time of admission.
