JUDGMENT

When the matter is taken up for hearing today, learned counsel for the first respondent-claimant has submitted that pursuant to the award passed by the authority under the Workmen's Compensation Act, the appellant-insurance company has deposited the entire amount and the same has been withdrawn by the claimant also. In such circumstances, it is submitted that nothing survives in this appeal. He has also made an endorsement in the case bundle to that effect. Learned counsel for the appellant-insurer also has consented to the said submission.

2. Recording the abovesaid submission, this Civil Miscellaneous Appeal is closed. No costs. Consequently, the connected M.P.No.3 of 2007 is closed.
