Application No.6558 of 2018 & Application No.7107 of 2018 in O.P.No.127 of 2016 D. KRISHNA KUMAR, J In A.No.2245 of 2017, Thaicom Public Company Ltd. has filed the present application in A.No.6558 of 2018 for detaining the Director and/or authorized representative of the respondent in civil prison, upon failure of the respondent to file a detailed affidavit setting out its list of assets.

2. The respondent in A.No.6558 of 2018 has filed an affidavit before this Court by furnishing the particulars of the immovable properties belonging to the respondent company and the copy of the same has been served on the counsel for the applicant viz., Thaicom Public Company Ltd. The learned counsel for the respondent has requested this Court to pass a common order to dispose of the aforesaid applications with liberty to the respondent to proceed further on the basis of the affidavit filed by the respondent and in accordance with law.

3. With the consent of the parties, this Court is inclined to pass the following order:

a) The affidavit filed by the respondent is taken on record.

vaan b) In respect of the respondent furnishing the list of immovable properties belonging to the respondent company, it is open to the parties to proceed further in accordance with law. A.No.6558 of 2018 in O.P.No.127 of 2016 is disposed of with the above directions. Consequently, A.No.7107 of 2018 in O.P.No.127 of 2016 is also disposed of.

6. On perusal of the record of evidence and having considered the serious concern of the allegations made by the Official Liquidator against the persons those who are involved in this serious crime, the Official Liquidator is directed to file a complaint before the Superintendent of Police, Coimbatore, to investigate into the matter for fabricating the said letter being used the letter-head of the office of the Official Liquidator under signed by one Mr.D.B. Babu, as Assistant Official Liquidator, High Court, Madras. After investigating in this regard, the Superintendent of Police shall forward the report to the District Collector, for taking appropriate action in accordance with law.

7. Post the matter after filing the report on 30.10.2018.
