ORDER

The petitioner, who was arrested and remanded to judicial custody on 04.03.2026 for the alleged offences under Sections 204, 316(4), 318(4) and 61(2) of BNS Act (Section 166, 409, 420 and 34 of Indian Penal Code, 1860, in Crime No.32 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the accused persons impersonated as GST officials and intercepted the employees of the defacto complainant and took away gold parcels weighing about 11⁄2 kg. Hence, the case was registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner, who is arrayed as A3, has nothing to do with the offence and even according to the prosecution, A5 impersonated as GST official and committed the offence. It is further submitted that the petitioner was arrested on 04.03.2026 and he is a businessman and his wife is working as a Sub Inspector of Police and he has no direct involvement in the offence. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the main accused are absconding and all the accused persons acted together by impersonating GST officials and committed the offence. It is further submitted that about 11⁄2 kg of gold has been looted and so far no recovery has been made and the investigation is still at the preliminary stage.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. This Court is of the view that considering the serious nature of allegation, the fact that huge quantity of gold has been robbed and no recovery has been made so far, and the investigation is at the preliminary stage, this Court is not inclined to grant bail to the petitioner.
