ORDER

This writ petition has been filed for issuance of a mandamus to the respondents to commission a 33/110 KV Substation as per the registered gift deed dated 28.11.2018, registered as Document No.1197 of 2018, or in the alternative to cancel the document and to handover the property.

2. Heard both sides.

3. The case of the petitioner is that the Electricity Department approached the grandfather of the petitioner to sell 2 acres of land for setting up a 33 KV substation by paying the then prevailing market value for the property. However, the petitioner's grandfather, considering the importance of the substation, decided to gift the land and accordingly, the document dated 28.11.2018 was executed and this was also registered as Document No.1197 of 2018.

4. The grievance of the petitioner is that the property is yet to be put to use by commissioning the substation, which will be of help to the nearby villages. The representation made by the petitioner, in this regard, also did not evoke any response. It is under these circumstances, the present writ petition has been filed before this Court.

5. The learned Standing Counsel appearing on behalf of the respondents submitted that the proposal is pending before the first respondent and a decision will be taken within the time frame fixed by this Court.

6. In the considered view of this Court, the property has been gifted to the Electricity Department for the purpose of commissioning a substation. This was done by the petitioner's grandfather keeping in mind the interest of the villagers, who will be benefited on the commissioning of the substation. This document was executed in the year 2018 and till date, there is no progress. Therefore, the petitioner has sought for a direction to the

respondents to either commission the substation or to cancel the document and return back the property. When the land has been given for a specific purpose, it has to be utilized by the Electricity Department. In view of the same, there shall be a direction to the first respondent to immediately take a decision for the commissioning of the substation in the subject property and the entire process shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.
