C.M.P.No.11189 of 2020 in C.M.A. SR.65604 of 2020 V.M.VELUMANI, J.

This petition is filed to condone the delay of 77 days in filing the above appeal.

2.The learned counsel appearing for the petitioner submitted that the present appeal is filed challenging only the quantum of compensation granted to the 1st respondent. In view of the same, the 2nd respondent is not a necessary party and notice is not necessary to the 2nd respondent.

3.Though notice has been served on the 1st respondent and his name is printed in the cause list, there is no representation for him either in person or through counsel.

4.Heard learned counsel appearing for the petitioner and perused the materials available on record.

5.Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 77 days is condoned and the petition is ordered.
