ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 05.04.2022 for the offences punishable under Sections 363, 376(3), 376(2)(n), 323 of IPC r/w Section 5(1), 6 of POCSO Act in crime No.12 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 03.04.2022, the defacto complainant's daughter aged about 14 years was physically abused by the petitioner. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. The Additional Public Prosecutor appearing for the respondent police would submit that when the victim girl aged about 14 years went to her grandparents' home, the petitioner forcibly had penetrative assault on her. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering that the petitioner had committed penetrative sexual assualt on the victim girl aged about 14 years, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
