Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the respondents and more specifically 3rd respondent to consider the petitioners representation dated 19.05.2024 and to reconvert the nomenclature of the land in S.No.315/1 which is situated at Paithoor village Attur Taluk and Sub- Registrar office and Salem District and to issue necessary revenue records such as patta, Chitta and Adangal to the petitioner.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed to direct the respondents and more specifically 3rd respondent to consider the petitioners representation dated 19.05.2024 and to reconvert the nomenclature of the land in S.No.315/1 which is situated at Paithoor Village, Attur Taluk and Sub- Registrar Office and Salem District and to issue necessary revenue records such as patta, Chitta and Adangal to the petitioner.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

4. The case of the petitioner is that subject property has been purchased by the petitioner and his brother and the revenue records have also been mutated in their name. Since the date of purchase they were cultivating in their land. The predecessors in their title are in possession of the land from the year 2/5

1966. While so, the patta has been in the name of the petitioner and his brother has been inadvertently converted as Government proamboke land. In the regard, the petitioner has given a representation to the respondents for reissue patta in their name. But the same has not been considered by them. Hence, the present Writ Petition.

5. Considering the limited prayer sought for in the Writ Petition, without going into the merits of the case, the respondents are directed to consider the representation of the petitioner dated 19.05.2024 and pass Order on merits and in accordance with law within a period of two months from the date of receipt of a copy of the Order.
