Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorarified Mandamus, calling for the records pertaining to the order made in Lr.No.Vu.Mi.Po/O&M/Che.Palli/Co.Thani/A.No.009/18-19 dated 07.04.18 passed by the second respondent and quash the same and issue consequential direction to the second respondent to give Service Connection based on the petitioner's application dated 04.04.2018.

ORDER

This writ petition is directed against the impugned order dated 7.4.2018 informing the petitioner that his application

cannot be processed, as there is an arrears of electricity charges accumulating to Rs.59,87,896/- from the year 1997.

2. Learned counsel for the petitioner submitted that the petitioner has already paid a sum of Rs.29,00,000/- on various dates. In addition thereto, the petitioner has also paid a sum of Rs.11,00,000/- through cheque yesterday. Since the Writ Appeal No.1353 of 2014 is also pending for consideration, subject to the result of the said writ appeal, as the petitioner has paid the entire amount, a direction can be issued to the respondents to effect the electricity service connection in favour of the petitioner.

Mr.S.K.Raameshuwar, learned standing counsel for the respondents also produced the letter dated 20.2.2019 issued by the Assistant Executive Engineer, O&M, Tiruppur Electricity Distribution Circle addressed to him stating that as on today, the balance payable by the petitioner to the respondents is running to Rs.19,87,896/-.

4. Considering the fact that W.A.No.1353 of 2014 is pending and the petitioner also claims that he has paid the entire amount to the respondents, the respondents are directed to effect the electricity service connection to the petitioner, subject to the result of the writ appeal, within a period of ten days from the date of receipt of a copy of this order.
