2.Heard the learned counsel for the petitioner and the learned counsel for second respondent and also perused the materials available on record.

3.Mr.C.Santhoshkumar, learned counsel undertakes to file vakalat for first respondent. Despite service of notice on the third respondent and his name is printed in the cause list, none appears for him.

4. On being satisfied with the averments stated in the affidavit filed in support of the petition this petition is ordered.

5.Registry is directed to number the Criminal Appeal, if it is otherwise in order.
