This Criminal Original Petition has been filed seeking a direction to the respondent police to alter an F.I.R in Crime No.24 of 2018, by implicating Section 307 of I.P.C.
2. In view of the law laid down by the Supreme Court in Shariff Ahmed and others vs. State (NCT of Delhi) [(2009) 14 SCC 184], this Court cannot issue a direction as to how they should conduct the investigation unlike civil cases, where the Code of Civil Procedure provides amendment of pleadings, there are no analogous provisions under the Code of Criminal Procedure for the amendment of FIR. It is for the investigating agency to file an appropriate alteration report, whenever it is found necessary. Hence, this petition is closed.
