Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Certiorarified mandamus, calling for the records relating to the impugned order of the 4th respondent dated 4th February 2011 in O.A.No.151 of 2011 on the file of 4th respondent and quash the same as highly illegal and violative of Article 14 and 16 of the Constitution of India and consequently direct the respondents 1 and 2 to redo the physical efficiency test manually as per clause 4 (ii) & (iii) of the Standing Order No.2/2002 dated 29.07.2002 issued with the approval of the Government of Puducherry as per Rule 7 and 10 of G.O.Ms.No.14 dated 20 March 2002. O R D E R
(delivered by K.K. SASIDHARAN,J.) The learned Government Pleader (Puducherry), representing the Government of Puducherry, submitted that nothing survives for adjudication in this writ petition, in view of the disposal of the original application by the Tribunal, by order dated 5 August 2014.
2. The writ petition is filed against an interim order. Now that the Original Application itself has been disposed of by the Tribunal, there is no question of adjudication of the merits of the order passed by the Tribunal. We are therefore of the view that the writ petition has become infructuous.
3. The writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petitions are closed.
