Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus calling for records of the 1st respondent in proceedings No.R.O.C.No.145465/2022/F2 dated 2.3.2023 and quash the same and consequently to issue certificate of Registration to the petitioner as a recognised Clerk of an Advocate and to order any other remedy. AMENDED AS Writ of Certiorarified Mandamus calling for the records of the 1st respondent in G.O.Ms.No.107 Home (Courts-V) Department dated 23.02.2021 and consequently to quash the proceedings in RO.C.No.83408/2020/F2 dated 22.03.2021 and R.O.C.No.145465/2022/F2 dated 02.03.2023 of the 3rd respondent and consequently to issue certificate of Registration to the petitioner as a recognised clerk of an Advocate and to order any other remedy.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Challenge made in this petition is to the existing guidelines contained in G.O.Ms.No.107, Home (Courts-V) Department, dated 23.02.2021, on the basis of which ROC No.145465/2022/F2 dated 02.03.2023 was issued, and to declare it as arbitrary and illegal.

2. During the pendency of this petition, on 25.07.2025, it was brought to the notice of this Court that the proposal regarding relaxation is at present pending consideration at the appropriate level. Taking into consideration the statement so made, eight weeks' time was granted. Thereafter, the case was listed from time to time.

3. It is stated that the matter is under active consideration and a decision is expected from the Committee within a period of eight weeks.

4. Taking into account that the proposal is under active consideration, we do not consider it appropriate to continue with this petition at this stage and we dispose it of. In case, the decision, if any taken, does not redress the grievance of the petitioner, the petitioner would be at liberty to revive the petition.

5. The petition stands disposed of with such liberty. There will be no order as to costs. Consequently, WMP No No.25386 of 2024 is closed.
