Defendant Prayer: This Civil suit is filed under Order IV Rule 1 of Original Side Rules r/w Order VII Rule 1 of CPC: (a) for directing the defendant to quit and deliver vacant possession of suit schedule property, which has been under use and occupation in the suit schedule property. (b) to pay damages at Rs.40,000/- p.m from 01.01.2008 till date of plaint which works to Rs.5,20,000/- p.m. The defendant is also liable to pay future damages of Rs.40,000/- p.m. or enhanced over and above depending on the future market rental value from the date of plaint till the date of possession and (c) for costs.

For Plaintiff: M/s. M.Anand Venkatesh No appearance.

For Defendant : M/s. G.Lakshmi @ Seetha Party-in-person.

JUDGMENT

This civil Suit is filed for recovery of possession and other reliefs.

2. Plaintiff side no representation. On perusal of the record reveals that there was no representation on behalf of the plaintiff on 07.02.2013 and this court directed to list the suit on 20.02.2013. Again when the suit was listed on 20.02.2013, there was no representation on behalf of the plaintiff and therefore, the suit was directed to be listed today under the caption for dismissal. Even today there is no representation on behalf of the plaintiff. The Defendant appeared in person.

3. Therefore, the suit is dismissed for default. No costs.
