Respondents Prayer: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents herein to consider the petitioners claim for providing Block Educational Officers as a feeder category for appointment by promotion to the post of District Educational Officer in the Tamil Nadu School Education service on the basis of drawing a combined seniority list of the Headmasters of High School by reckoning the seniority of Block Educational Officers from the date of their initial appointment as Block Educational Officer or by providing a separate ratio for the distinct category of Block Education Officers for appointment by transfer as District Educational Officer and pass appropriate orders for bringing forth suitable amendment to the relevant Special Rules. This writ petition has been filed for mandamus to direct the respondents herein to consider the petitioners claim for providing Block Educational Officers as a feeder category for appointment by promotion to the post of District Educational Officer in the Tamil Nadu School Education service on the basis of drawing a combined seniority list of the Headmasters of High School by reckoning the seniority of Block Educational Officers from the date of their initial appointment as Block Educational Officer or by providing a separate ratio for the District Educational Officer and to call for the records in connection with the impugned Disqualification slip bearing Enrolment No.0508004 dated 27.07.2021 issued by the 2nd respondent and quash the same and further direct the respondents to re-measure the petitioner height by considering the petitioner's representation dated 02.08.2021 for the post of GR-II-Police Constable, Jail Warder, Fireman in the common Recruitment 2020. According to the petitioner representation dated 17.09.2020 has not been considered by the 1st respondent.
2.The learned Government Advocate for the respondents submitted that the representation does not bear any acknowledgement obtained by the petitioner from the respondent for being consideration. Whether, the petitioners are entitled to any relief in their representation is to be first considered by the respondent.
3.Therefore, this writ petition is disposed by directing the petitioners to file a fresh representation within a period of two weeks from the date of receipt of a copy of this order with the 1st respondent. The 1st respondent is directed to consider the aforesaid representation of the petitioners, if any, that may be filed within a period of 60 days thereafter. No costs. Consequently, connected miscellaneous petition is closed.
