Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondents to extend the benefits of G.O.Ms.No.281, Finance [Pay Cell] Department dated 02.04.1987 and G.O.Ms.No.304, [Pay Commission] Department dated 28.03.1990 to the petitioner considering the representation dated 14.09.2015.

ORDER

By consent, the writ petition is taken up for final disposal.

The petitioner joined the services of the Dominic Savio Higher Secondary Aided School, Tirupathur,

Vellore District, as Secondary Grade Teacher on 21.09.1995 and was promoted as B.T.Assistant and she was not granted selection grade scale of pay and according to her, as per G.O.Ms.No.281, Finance [Pay Cell] Department dated 02.04.1987, a person who has completed total service of 20 years, is entitled to move to special grade and similarly as per G.O.Ms.No.304, of the very same department dated 28.03.1990, an employee stagnating in the selection grade, shall be granted special grade with two increments and the petitioner has not been conferred with the selection/special grade scale of pay, though she has put in required years of service and in this regard, she has submitted a representation dated 14.09.2015 to the respondents and since no orders have been passed, she came forward to file this writ petition. Heard the learned counsel for the petitioner and Mr.S.Gunasekaran, learned Government Advocate who accepts notice on behalf of the respondents 1 to 3.

Though the petitioner has prayed for a larger relief, this Court, in the light of the facts and circumstances, directs the 2nd respondent to consider and dispose of the petitioner's representation dated 14.09.2015 on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, by the petitioner.

The writ petition is disposed of accordingly. No costs.
