PRAYER:

This petition is filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the respondents to dispose the petitioner's representation dated 06.12.2014 within stipulated time on merits for compliance of Circular No. 67, dated 03.11.2011 passed by the 2nd respondent.

ORDER

The petitioner made a representation dated 06.12.2014 to the respondent Nos. 1 to 4 alleging that fraud has been committed by the private respondents, despite the fact that the petitioner and her mother are having title of the property along with a decree in their favour by a Competent Court. As the said representation is yet to be disposed of, the present writ petition is filed by the petitioner before this Court seeking a direction to the respondent concerned, to conduct enquiry as per Circular No. 67, dated 03.11.2011, passed by the 2nd respondent.

2. Heard the learned counsel appearing for the petitioner and learned Additional Government Pleader for the respondent Nos. 1 to 4.

3. Considering the above facts and without going into the merits of the case and taking note of the pendency of the representation of the petitioner dated 06.12.2014, a direction is hereby issued to the respondent No. 3 to consider and pass appropriate orders on the representation of the petitioner dated 06.12.2014, within a period of eight weeks from the date of receipt of the copy of this order, after affording an opportunity of hearing to the petitioner as well as the private respondents. The writ petition is disposed of accordingly. No costs.
