Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Certiorarified Mandamus, to quash the impugned Refusal Check slip bearing No.RFL/Anna Nagar/54/2025 dated 16.4.2025 and consequently direct the 1st respondent to register the Settlement Deed executed by the petitioner in favour of her husband i.e.1) Periyakaruppan, S/o.Anbazhagan aged about 55 years, dated 16.4.2025 without insisting on production of original documents and permit the petitioner to represent the same within the stipulated time. This writ petition has been filed challenging the impugned refusal check slip issued by the third respondent dated 16.04.2025 and for a consequential direction to the third respondent to register the settlement deed executed by the petitioner in favour of her husband.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

3. The impugned refusal check slip has been issued mainly on 2/5

the ground that the original title documents were not produced at the time of registration. Insistence of the original title document by the third respondent may not be necessary in view of the circular issued by the Inspector General of Registration dated 28.04.2025. That apart, the petitioner in the affidavit filed in support of the writ petition has stated that the original title document has been lost and a paper publication was also given in this regard and original title document was not be able to traced. In such an event, a recital shall be added in the settlement deed.

The learned Additional Government Pleader, on instructions, submitted that there is a discrepancy in the Town Survey number between the document that was presented for registration and the patta that stands in the name of the petitioner. This issue can be easily resolved, if the petitioner mentions the very same Town Survey number in the settlement deed also corresponding to the Town Survey number found in the revenue records.

5. The petitioner on satisfying the above requirement, shall represent the settlement deed which shall be registered by the third respondent, if it is otherwise in order.

In the result, the Writ Petition is allowed. There shall be no order as to costs.
