The writ petition has been filed for a direction to the 2nd respondent to conduct an enquiry based on the petitioner's representation dated 14.03.2024 and pass orders thereon, within a time stipulated by this Court.
2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents 1 to 4 and perused the materials available on record.
3. It is the case of the petitioner that the subject property was inherited by his father by way of a Settlement Deed dated 09.05.1950, executed by the petitioner's grandmother. Since the petitioner's brothers 2/4
and sisters have executed a Joint Release Deed dated 22.07.2021 in favour of the petitioner, he applied for issuance of patta in his favour. This request of the petitioner was rejected on the ground that patta is in the name of the respondents 5 and 6. Therefore, the petitioner sent a representation dated 14.03.2024 to the 2nd respondent requesting to cancel the patta No.718, which stands in the name of the 3rd parties. Since no action has been taken on the said representation, the petitioner has filed the present writ petition.
4. Considering the limited relief sought in this writ petition, the 2nd respondent is directed to consider the representation of the petitioner dated 14.03.2024 and pass appropriate orders in accordance with law, after hearing the petitioner as well as the respondents 5 and 6, within a period of two months from the date of receipt of a copy of this order. With the above direction, this writ petition is disposed of. No costs. 07.06.2024 gya Index : Yes/No 3/4
