Therefore, the notice is deemed to have been served on the respondent. There is no representation on behalf of the respondent as well as the respondent is set exparte. The telephonic conversation that has taken place between the respondent and the Managing Director of the applicant company shows that the respondent has been threatening the applicant that he would approach the press.

2. The learned counsel for the applicant would submit that the Pollution Control Board had issued notice to them for which they have already replied to and in the event the respondent is permitted to utilise the trade secrets of the petitioner that he knows it would cause great prejudice to the applicant.

3. Considering the above, the interim order already granted is made absolute and the application is allowed.
