This application has been filed to pass an order prohibiting the Garnishee from making payment of a sum of Rs.4,06,549.73 or any amount to the Respondent or to respondent's men, agents, representatives or to anyone claiming on respondent behalf and restrain the respondent or respondent's men, agents, representatives or anyone claiming on respondent behalf from receiving a sum of Rs.4,06,549.73 or any amount from the Garnishee and further direct the Garnishee to deposit the sum of Rs.4,06,549.73 or any amount to the credit of the above application.

2. Heard Mr.D.Pradeep Kumar, learned counsel for the applicant.

3. Service of notice on the respondents through Court is awaited. However, Affidavit of Service filed by the applicant, enclosing the acknowledgment card, indicates that notice had been duly served on the respondents. The names of the respondents have also been printed in the cause list today and when the matter was taken up, there is no representation on the

side of the respondents neither through counsel nor did they appear before this Court. They are called absent and set ex-parte.

4. Having satisfied with the averments made in the affidavit and also the materials placed on record, there shall be an order, prohibiting the second respondent from making in payment to the tune of Rs.4,06,549.73/- or any other lesser amount that is payable to the first respondent, pending the arbitration between the first and directing the second respondent to deposit the same to the credit of this instant Arbitration Application No.908 of 2026 within a period of four weeks.
