JUDGMENT

Challenge has been made to the decree and judgment of the trial Court decreeing the suit directing the defendant to pay a sum of Rs.6,67,564/- with future interest at the rate of 7.5% per annum from the date of plaint till realization, in the present Appeal Suit.

2. When the matter is taken up today, the learned counsel for both sides submitted that the matter has been settled between them and they had agreed to settle their accounts for a sum of Rs.6,67,564/- and a demand draft for the Page 2 / 4

above said sum has been handed over to the respondent. The same has also been accepted by both sides in the compromise memo filed by them.

3. In view of the compromise arrived between the parties, this Appeal Suit is disposed of in terms of the compromise filed by the parties and the judgment and decree of the trial Court in O.S.No.65 of 2017 dated 31.08.2021 is set aside. No costs. The compromise memo filed by the parties dated 26.04.2025 shall form part of the decree. The registry is directed to refund of Court Fees as per law.
