CR.NO.347/2016 Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition imposed Crl.P.No.27251/2019 dated 22.10.2019 on condition that the petitioner shall appear before trial court i.e Additional District Judge Namakkal, daily at 10.30 a.m. till completion of trial to secure ends of justice.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S. A.RAMESH, Advocate for the petitioner and of MR. G.RAMAR, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This petition has been filed to modify the condition in Crl.O.P.No.27251 of 2019 on condition that the petitioner shall appear before trial court i.e. Additional District Judge, Namakkal, daily at 10.30 a.m. till completion of trial to secure ends of justice.

2.Heard both sides.

3.The learned Government Advocate Criminal Side Mr.G.Ramar stated that there are 65 prosecution witnesses and the trial has not yet commenced.

4.In view of that, the earlier order dated 05.11.2020 is maintained and considering the submission, the condition imposed as against the petitioner is modified to the effect that the petitioner herein may appear before the Additional District Court, Namakkal once in every alternate Mondays at 10.30 a.m. and also appear during every hearing date before the trial. If the petitioner defaults complying with the conditions on two consecutive Mondays as stated then the prosecution is at liberty to seek modification of this particular order.
