Heard Mr. Murali Krishnan, learned counsel appearing for the petitioner and Mr.Manokaran Sundaram, learned Standing Counsel, appearing for the respondent.

2. The petitioner has filed this writ petition seeking for a writ of Certiorari, to call for the records of the respondent in CST-732023/2014-15 and quash the order, dated 15.09.2015.

3. It is submitted by the learned counsel for both sides that the issue involved in this writ petition is squarely covered by a decision of the Hon 'ble Division of this Court, in the case of M/s.Schwing Stetter (India) Pvt Ltd., v. The Commissioner of Commercial Taxes, Chennai - 5 in W.P.Nos.37604 of 2007 etc., batch case.

4. Following the same, this writ petition is disposed of. Liberty is granted to the petitioner herein to file an appeal, as against the impugned assessment order before the appellate authority and if the appeal is filed within a period of thirty days https://hcservices.ecourts.gov.in/hcservices/

from the date of receipt of a copy of this order, the appeal shall be entertained without reference to the limitation. No costs. Consequently, the connected MP is closed.
