ORDER

This contempt petition has been filed to punish the respondent for disobeying the order passed by this Court in Crl.M.P.No.5271 of 2025 in Crl.OP.No.8087 of 2025 dated 19.03.2025, and thereby directing the respondent "no final report shall be filed" in Crime No.464 of 2024.

2. Learned counsel for the petitioner submitted that though this Court passed the above said order, the respondent failed to comply with the order of this Court, filed a final report, consequently, the Trial Court had also issued summons on 24.03.2025, and thereby the respondent committed contempt of the Court.

3. The learned Government Advocate (Criminal side) appearing for the respondent present before this Court along with respondent and produced a detailed affidavit dated Nil, (Signed on 25.06.2025), along with a certified copy of the postal ledger to show the acknowledgment of receiving the order copy by the respondent. The affidavit filed by the respondent was taken on record.

4. Heard both sides and perused the materials available on record, including the affidavit filed by the respondent.

5. On perusal of the records, including the detailed affidavit filed by the respondent and upon considering the submissions made by the learned Government Advocate appearing for the respondent, it is clear that this Court had passed an interim order on 19.03.2025, which was dispatched by this Court on 27.03.2025 and duly communicated to the respondent on 29.03.2025.

6. Before receiving the copy of the order dated 19.03.2025 passed in Crl.M.P.No.5271 of 2025 in Crl.OP.No.8087 of 2025 of this Court, the respondent had filed a final report on 21.03.2025 after completing the investigation in Crime No.464 of 2024, and the same was taken on cognizance on the file of the Judicial Magistrate No.1, Thiruvallur in C.C.No.108 of 2025.

7. Therefore, it is evident from the records that on the date of filing the final report, the respondent had no knowledge about the interim order passed by this Court. Accordingly, no contempt is made out as against the respondent.
