Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents not to demolishing or level the water channel bund situated in Survey No.50 in Akkichettipalayam Village, Attur Taluk, Salem District and to lay road and further direct the respondents to ensure free flow of water in the channel without any blockage in any manner. ORDER

(Order of the court was made by V.LAKSHMINARAYANAN,J.) This writ petition has been filed by the petitioner for issuance of a writ of mandamus to direct the respondents not to demolish or level the water channel bund in Survey No.50 situated at Akkichettipalayam Village, Attur Taluk, Salem District, and to lay a road and to further direct the respondents to ensure free flow of

water in the channel without any blockage in any manner.

2. When the writ petition is taken up, Mr.S.Prabhakaran, learned Government Advocate, on instructions, submits that only the encroachments on the bund have been removed and there is no proposal to remove the bund situated at Survey No.50 in Akkichettipalayam Village, as apprehended by the petitioner.

3. This Court records the aforesaid submission made by learned Government Advocate. That apart, there is no cause of action for filing the present writ petition, as the apprehension of the petitioner is unfounded.

4. The writ petition is disposed of accordingly. There will be no order as to costs. Consequently, W.M.P.No.15597 of 2023 is closed.
